How to meet the Australian Study Requirement There are 2 main reasons why the Australian Study (used to be called the 2-Year Study) is considered to be very important:

1.) To be eligible for the Graduate Temporary Subclass 485 Visa

2.) The Graduate Temporary Visa Subclass 485 is considered to be a highly beneficial visa as it gives permission to students to stay in Australia after they have completed their studies so they can improve on their chances to become permanent residents in the country.

2 Academic Years (92 weeks) Registered Duration

Exemptions and Recognition of Prior Learning

In the scenario however, where a student is exempted from his or her prior studies, or what is called as the Recognition of Prior Learning (RPL), then this would have been previously become a huge factor in meeting the requirement for the 2-year study.

After the Federal Court case of Riaz & Anor v Minister for Immigration & Anor [2013] FCCA 2244 (20 December 2013) however, previous studies or RPL, whether they have been taken in Australia or in another country, does not bear any effect on the 2-year study requirement.

As long as the completed course or courses are registered for a duration of 92 weeks, the student would meet the requirement of ‘2 Academic Years,’ even if they were not able to spend the usual duration completing the course because of RPL or the given exemptions.

The biggest condition to this is that the student will also be required by the legislation to have completed at least 16 months from commencement right to the completion of the qualification(s).

Qualifications Needed

Only a few qualifications can be considered to be eligible for the Australian Study Requirement, and these are:

Trade Certificates – applicant must have qualifications at the Certificate III level or higher in an occupation in Major Group 4 of the Australia and New Zealand Standard Classification of Occupations (ANZSCO).

Diplomas / Advanced Diplomas – Associate Degrees is now included under the Departmental Policy.

Degrees – Bachelor Degrees, Graduate Diplomas, Masters, as well as PhDs.

There are certain qualifications that would not normally be considered towards the 2-year study requirement. These are as follows:

Graduate Certificates

Qualifications at the Certificate II level or lower in a Trade Occupation

Qualifications at the Certificate IV which are not in a Trade Occupation

For the Post Study Work stream of the Graduate Temporary Subclass 485 Visa, note that the only degrees that count are Bachelor Degrees, Masters, and PhDs.

Having more than 1 Qualification

Provided that all are eligible qualifications as stated above, it is not impossible to count more than 1 qualification towards the Australian Study requirement, and even if you got a long break between studying, this would still be the case.

The bottomline here is qualifications need not be related to your nominated occupation however, there is a main exception here and it is the Graduate Work Stream of the Subclass 485 Visa, which would require all your qualifications to be closely related to the occupation you are nominated for.

Qualifications that are Nested or Packaged

It is usually common for a series of qualifications to be packaged or nested together to lead to a diploma or a trade qualification. The time that was spent studying can normally be counted towards the 2-year study requirement although the lower qualifications may not be counted as eligible qualifications.

The most common example is when a student completes a Diploma of Business as well as a Certificate II, Certificate III, and a Certificate IV. Given that each qualification is registered for 26 weeks, then this would all be added up to a total of 104 weeks of registered study, provided that the course is nested or packaged. So even if Certificates II, III, and IV are not really eligible qualifications, then this would be the case for this particular scenario.
